The California Air Resource Board (CARB) on 24 October 2023 notified stakeholders and the public that the United States Environmental Protection Agency (U.S. EPA) granted CARB's authorization request for the Final Regulation Order Control Measure for Ocean‑Going Vessels At Berth (2020 Regulation) pursuant to section 209(e) of the Clean Air Act.
The authorization has been published in the Federal Register on 20 October 2023.
Beginning 20 November 2023, all regulated entities must comply with the requirements set forth in the 2020 Regulation as the “transition period” provided in the March 2023 Enforcement Notice concludes on 19 November 2023.
At the conclusion of the transition period, the two enforcement path options provided by the March 2023 Enforcement Notice will no longer be in effect.
CARB staff issued an updated Enforcement Notice on 24 October 2023 to confirm the end of the transition period and to provide updated information to regulated entities about upcoming requirements.
