The Panama Maritime Authority issued the amended circular MMC-288 addressing Special Purpose Ships (SPS) as defined by the SOLAS Convention.
This circular was published on 1 June 2024.
The circular emphasizes that in addition to complying with general SOLAS regulations, special purpose ships must also hold specific certificates depending on their type:
- Passenger Ships: These ships require a SOLAS Exemption Certificate tailored to passenger vessel operations. This certificate signifies that while the ship may be exempt from certain SOLAS requirements, it still meets safety standards appropriate for passenger transport.
- Cargo Ships: Similarly, cargo ships may require a SOLAS Exemption Certificate, depending on the determination of the flag Administration. This certificate ensures that the cargo ship can operate under specific conditions while maintaining safety standards equivalent to SOLAS requirements.
- Certificate Duration and Validity: The circular stipulates that the duration and validity of these certificates for special purpose ships should align with the respective provisions applicable to cargo ships under SOLAS. This ensures consistency in safety standards and regulatory compliance across different types of vessels.
- Exemptions for Non-Regular Special Purpose Ships: The circular addresses scenarios where a ship that is not typically designated as a special purpose ship may undertake a single exceptional voyage in that capacity. In such cases, the Administration has the authority to grant exemptions from certain provisions of the SPS Code. However, this exemption is contingent upon the ship meeting adequate safety requirements as deemed appropriate by the Administration for the specific voyage it intends to undertake.
- Safety Certificate Format: It is noted that the Safety Certificate for Special Purpose Ships follows a specified format provided in the Annex to the SPS Code. This format ensures uniformity in documentation and facilitates easy verification of compliance with safety standards by relevant authorities.
- Authorization to Issue Certificates: The circular confirms that Recognized Organizations duly approved by the Republic of Panama are authorized to issue the Special Purpose Ship Safety Certificate on behalf of the flag Administration. This delegation of authority ensures that certification processes are efficient and conducted by qualified entities with the necessary expertise.
