Cayman Islands guidance on 2024 CIC: Focus on crew wages and seafarer employment agreements

The Maritime Authority of the Cayman Islands (MACI) has issued guidance for a Concentrated Inspection Campaign (CIC) on Crew Wages and Seafarer Employment Agreements (SEAs) running from September 1 to November 30, 2024.

This campaign will focus on several key areas:

  1. Medical Certification and Training: Ensure all seafarers have current records of their training and certifications.
  2. Seafarer Employment Agreements (SEAs): SEAs should be approved by the Flag State, signed by all seafarers, and accurately reflect their positions and terms of employment.
  3. Wage Payments: Wages must be paid regularly (no longer than monthly) and free from unauthorized deductions. Documentation of wage payments must be provided, and records should be clear and accurate.
  4. Hours of Work and Rest: There should be a posted schedule for work and rest hours, with records kept onboard. Seafarers should receive copies of their records and appropriate shore leave.
  5. Financial Security: Certificates for financial security in cases of abandonment, death, and long-term disability must be displayed onboard.

For yachts, there are specific guidelines:

  • Occasional Workers: These workers, like nannies or masseuses, should not be listed on the Crew List but on a Record of Occasional Workers. They need proper accommodation, emergency training, and a contract that provides protections similar to those under the MLC.
  • Day Workers: Temporary day workers should not be included on the Crew List or Record of Occasional Workers and should follow local employment and immigration laws.
