Bermuda amends Declaration of Speed Limits for Boats

The Bermuda Ministry of Transport has issued the notice on speed limits for boats.

This document has been issued on December 13th, 2022, and entered into force on the same date.

This Notice, which amends the Marine Board (Declaration of Speed Limits for Boats)(Mariners) Notice 2001 (“the principal Notice”), may be cited as the Marine Board (Declaration of Speed Limits for Boats) (Mariners) Amendment Notice 2022.

Paragraph 3(1) of the principal Notice is amended by deleting all the words and substituting “For the purposes of Ferry Reach, a person navigating a boat within 100 metres of the shoreline shall not exceed 15 nautical miles per hour.”

Paragraph 3A of the principal Notice is revoked.

The principal Notice is amended by inserting the following after paragraph 5—

“Speed limits not applicable in an emergency

(5A) Paragraphs 2 and 3 do not apply to boats responding to an emergency.

Boatmen to exercise caution

(5B) Notwithstanding paragraphs 2, 3 and 5, all mariners, pilots and boatmen must exercise extreme caution at all times, especially when approaching other boats.

Offence

(5C) It is an offence under section 10(3) of the Marine Board Act 1962 for the master of a ship or boat to fail to observe the requirements of this Notice, punishable on summary conviction in accordance with section 112 of that Act.”.
