The International Maritime Organization issued resolution A.1187(33), adopted on 6 December 2023, concerning the 2023 Non-exhaustive list of obligations under instruments relevant to the IMO Instruments Implementation Code (III Code).
The resolution:
- Recalls previous resolutions and conventions related to maritime safety and pollution prevention from ships.
- Recognizes the need to revise annexes to the Non-exhaustive list of obligations to incorporate amendments to IMO instruments relevant to the III Code.
- Affirms the primary responsibility of states to ensure compliance with international maritime rules and regulations.
- Emphasizes the importance of all states fulfilling their obligations under relevant instruments.
- Notes the mandatory use of the III Code under various international conventions and protocols.
- Adopts the 2023 Non-exhaustive list of obligations and urges governments to utilize it in implementing IMO instruments nationally.
- Requests the Maritime Safety Committee and the Marine Environment Protection Committee to review and amend the list as necessary.
- Revokes resolution A.1157(32).
The annex to the resolution includes the 2023 Non-exhaustive list of obligations, organized into sections detailing obligations of contracting governments/parties, specific flag state obligations, specific coastal state obligations, specific port state obligations, instruments made mandatory under IMO conventions, summary of amendments to mandatory instruments, and amendments to IMO instruments expected to be accepted and enter into force between January 1, 2024, and July 1, 2024.
